In these Terms and Conditions, the following definitions apply:
Customer means any individual, business, or organisation that requests or receives services from Waste Disposal Barnes.
Services means any waste disposal, waste collection, removal, clearance, recycling, or related services supplied by Waste Disposal Barnes.
Contract means the agreement between the Customer and Waste Disposal Barnes for the provision of Services, incorporating these Terms and Conditions.
Waste means any items, materials, refuse, rubbish, or goods to be collected or disposed of as part of the Services, including household waste, commercial waste, bulky items, and recyclable materials, subject to applicable regulations.
Waste Disposal Barnes provides waste collection and disposal services for households and businesses, including regular collections, one-off clearances, and special waste removal where agreed. The specific nature of the Services will be described in the booking confirmation or any written quote issued by us.
All Services are subject to applicable UK waste and environmental regulations, and we reserve the right to refuse to collect or handle any Waste that does not comply with these regulations, or which may pose health, safety, or environmental risks.
3.1 Customers may request a booking for Services by telephone, email, or through any booking facility we may provide from time to time. A booking is only accepted once we confirm the details and price, either verbally or in writing.
3.2 At the time of booking, you must provide accurate information regarding the type, quantity, and location of the Waste to be collected, as well as property access details, parking arrangements, and any relevant restrictions.
3.3 Any quote provided is based on the information supplied by the Customer. If on arrival the Waste quantity, type, or access conditions differ substantially from what was described, we may adjust the price, amend the Services, or decline to complete the collection.
3.4 The Contract is formed when we accept your booking and you confirm that you agree to these Terms and Conditions.
4.1 The Customer must ensure safe, adequate, and lawful access to the premises or site where the Waste is to be collected. This includes making sure that any gates, doors, or communal areas are unlocked or otherwise accessible at the agreed time.
4.2 The Customer is responsible for obtaining any necessary permissions or authorisations from landlords, managing agents, neighbours, or local authorities where required for access, parking, or waste removal activities.
4.3 The Customer must ensure that Waste is presented in a safe and suitable manner for collection, for example bagged where appropriate, separated where required, and not containing any prohibited items such as hazardous substances unless expressly agreed in advance.
4.4 If we are unable to access the premises or complete the collection due to Customer fault, incomplete information, or failed access arrangements, we may charge a call-out or cancellation fee as described in these Terms and Conditions.
5.1 The price for the Services will be as quoted at the time of booking or as otherwise confirmed in writing. Unless specified otherwise, prices are inclusive of collection, transport, and lawful disposal of the Waste.
5.2 We may require payment in advance of carrying out the Services. Where payment on completion is agreed, it must be made immediately upon completion of the collection, using an accepted payment method such as debit card, credit card, or bank transfer, as advised by us.
5.3 If the volume or type of Waste collected differs from that originally booked, we reserve the right to adjust the price accordingly before completion of the job. We will advise you of any changes to the price, and the adjusted amount must be paid in full in order for the Services to proceed.
5.4 All invoices are payable by the due date stated on the invoice. If no date is specified, payment is due immediately on receipt. We reserve the right to charge interest and reasonable recovery costs for overdue amounts.
5.5 Any additional charges arising from parking fees, congestion zones, tolls, or other local charges directly related to the provision of the Services may be added to the final bill and are payable by the Customer.
6.1 Customers may cancel or amend a booking by contacting us as soon as possible. Cancellations and amendments are only effective once we confirm receipt.
6.2 If the Customer cancels more than 24 hours before the scheduled collection time, any pre-paid amount may be refunded, subject to deduction of any reasonable administrative costs incurred.
6.3 If the Customer cancels within 24 hours of the scheduled collection time, we reserve the right to charge a cancellation fee up to the full price of the booked Services, particularly where resources have already been allocated.
6.4 If we arrive on site at the agreed time and are unable to complete the collection due to lack of access, absence of the Customer where access is required, or incorrect information about the Waste or location, this may be treated as a late cancellation, and a fee may be charged.
6.5 We may cancel or reschedule the Services at any time due to reasons beyond our reasonable control, including but not limited to severe weather, operational issues, vehicle breakdowns, or safety concerns. In such cases, we will notify you as soon as reasonably possible and either rearrange the booking or issue a refund for any pre-paid amount relating to the cancelled Services.
7.1 All Services are provided in accordance with applicable UK waste management, environmental, and duty of care regulations. Waste Disposal Barnes will transport and dispose of Waste only at appropriately licensed facilities.
7.2 Certain types of Waste are classed as hazardous or restricted, including but not limited to chemicals, solvents, asbestos, clinical waste, gas bottles, paints, oils, and electrical items containing harmful components. Such items may only be collected where expressly agreed in advance and may be subject to additional charges and conditions.
7.3 The Customer is responsible for clearly identifying any hazardous or special Waste and for providing any information reasonably required for safe handling and lawful disposal. We may refuse to collect any Waste that we reasonably believe is hazardous, illegal, or unsafe to handle.
7.4 Title and responsibility for the Waste passes to Waste Disposal Barnes once it is loaded into our vehicle, except where the Waste is later identified as prohibited or unlawfully presented by the Customer. In such cases, we reserve the right to return the Waste or require the Customer to reimburse any costs incurred in dealing with it.
7.5 The Customer must not include in the Waste any confidential or sensitive documents or items unless they have made specific prior arrangements for secure destruction. We do not accept liability for any loss or disclosure of information arising from Waste material placed for collection without such arrangements.
8.1 We will provide the Services with reasonable care and skill, using appropriately trained personnel and suitable vehicles or equipment for the type of Waste and location.
8.2 Any collection times or dates provided are estimates and are not guaranteed, although we will make reasonable efforts to attend at the agreed time. Time shall not be of the essence unless expressly confirmed in writing.
8.3 We do not guarantee that all Waste will be recycled, but we will aim to maximise recycling and recovery wherever reasonably practicable in accordance with industry standards and local facility availability.
8.4 We are not responsible for any cleaning, repairs, or remedial works required at the Customer's premises unless caused directly by our negligence. The Customer is responsible for ensuring that the area is suitable for collection activities.
9.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded under UK law.
9.2 Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Services or the Contract, whether in contract, tort, negligence, or otherwise, shall not exceed the total price paid or payable for the specific Services giving rise to the claim.
9.3 We shall not be liable for any indirect, consequential, or special loss, including but not limited to loss of profits, loss of business, loss of opportunity, or loss of goodwill, arising from or in connection with the Services.
9.4 We will not be liable for any damage to driveways, access ways, underground services, or property where the Customer has requested or agreed that our vehicles or staff operate in areas that are not designed or rated for such use.
9.5 The Customer shall be responsible for any loss or damage suffered by us arising from the Customer's breach of these Terms and Conditions, including any costs associated with dealing with prohibited, hazardous, or misdescribed Waste.
10.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible, providing full details of the issue.
10.2 We will investigate complaints in a fair and timely manner and may request additional information or evidence. Where appropriate, we may offer a remedy such as a partial refund, re-attendance, or other corrective action, at our discretion and subject to the circumstances.
11.1 Any personal data provided by the Customer for the purpose of booking and delivering the Services will be processed in accordance with applicable UK data protection laws.
11.2 We will use your contact details to manage bookings, process payments, and communicate regarding the Services. We may also retain certain records for legal, financial, or operational reasons as required by law or good practice.
12.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that Contract.
12.2 Any significant changes will, where practicable, be made available through our usual communication channels. Continuing to use our Services after changes take effect will constitute acceptance of the updated terms for future bookings.
13.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
13.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or the Contract.
14.1 If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.2 No failure or delay by Waste Disposal Barnes in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
14.3 The Contract and these Terms and Conditions constitute the entire agreement between the Customer and Waste Disposal Barnes in relation to the Services, and supersede any prior understandings or arrangements, whether written or oral.
14.4 The Customer may not assign or transfer any of their rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations where necessary for operational reasons, provided that this does not reduce the level of service or protections afforded to the Customer under these Terms and Conditions.
